In what cases do you qualify for Italian Dual Citizenship?
CITIZENSHIP JURE SANGUINIS (BY DESCENT)

Italian citizenship is granted by birth through paternal or maternal line, with no limit on the number of generations.
Italian citizenship laws are based on the principle of recognition of citizenship by paternal or maternal derivation to the citizen’s child, regardless of the place of birth.
To be recognized as an Italian Citizen by descent you must prove that:
1. You are a descendant of an Italian Citizen, no limit on the number of generations.
2. The line of citizenship has never been interrupted over the generations leading to you. This means that the child of the Italian ancestor was born before the naturalization of the parent as citizen of another country and none of the descendants renounced to Italian Citizenship.

ITALIAN CITIZENSHIP FOR DESCENDANTS OF WOMEN
For the Italian Consulates, a woman of Italian descent can pass on Italian citizenship to her children only if they were born after January 1, 1948.
However, the Supreme Court of Rome decided that this discrimination against women should cease and granted Italian citizenship to women’s’ descendants. So, at this time, gaining Italian citizenship through a female ancestor whose child was born before January 1, 1948 can only be done through an appeal filed in an Italian Court.

CITIZENSHIP JURE MATRIMONII (BY MARRIAGE)
The foreign spouse of an Italian citizen may request to acquire Italian citizenship.
Italian residents married to Italian citizens can apply after two years of legal residency. The term is reduced by half when children are born or legally adopted within the couple.
Foreign nationals that are residents outside Italy are eligible to apply three years after the date of marriage/civil union to an Italian Citizen. The term is reduced by half when children are born or legally adopted within the couple.

RE-ACQUISITION OF ITALIAN CITIZENSHIP
According to Italian Law, the acquisition of a foreign citizenship by an Italian citizen after August 15, 1992 does not incur the loss of his/her Italian citizenship.
On the other side, individuals born in Italy who became U.S. (or any other country) citizens by naturalization before August 16th, 1992, automatically lost their Italian Citizenship but they may reacquire it by establishing legal residency in Italy.
